The FCC denied Fox network's appeal to an indecency fine of $91,000. Late last month, FOX announced that it would not pay the fine brought on by long-forgotten reality show "Married by America." In 2003, Fox broadcasted an episode of the show that featured digitally obscured strippers and a woman licking whipped cream off a man's nipple. According to the Fox network, only 90 complaints were received, from only 23 people. On top of that they allege that only two of those complaints were unique. What that means is that the 23 complaints probably came from an organization or a group of friends who sent in the same form letter.
This has been a long legal battle for Fox. In 2004, they were originally hit with a $1.2 million dollar fine. Fox has continually appealed the process. And so far it has reduced the total cost. The fine has been reduced to only include 13 station affiliates (from the original 169 stations) which brings the total currently owed to $91,000. There is another case that Fox is involved in that is currently pending before the U.S. Supreme Court. When heard by the Supreme Court, it will be the first time the Supreme Court has ruled on what constitutes offensive speech (in this case, the utterance of "fuck" by Cher and "shit" by Nicole Ritchie in 2003 and 2004) since the 1970s.
Court cases aside, it's not the first time that Fox has been called out for vulgarity. A documentary was created by the production company "Brave New Film" that calls into question Fox's use of the controversial images and videos in their news segment. The film is "Fox News Porn" and it's available on DVD now. It asserts that Fox News' coverage of Anna Nicole Smith outweighed their coverage of the Iraq war compared to other networks. Not to be biased, the trailer for "Fox News Porn" includes snippets from Fox's business news shows as well.
